The auction rules and arbitration policies of EzLane Auto Auctions Inc.
Herein referred to as (the auction).
EzLane Auto Auctions Inc. is an internet-based dealer-only live auto auction. Any changes in the
auction regulations or arbitration policies will be posted at staging.ezlane.com prior to
implementation. The selling dealer must give the buying dealer complete and accurate
information. Our guarantee to the buyer is if the vehicle is misrepresented by the seller or
EzLane, we will void the transaction but only in accordance with the following terms and
conditions. Each dealership/representative is responsible for the confidentiality of their
passwords and account numbers. We do not guarantee our website to be without errors,
viruses, or continuously operational. This website, logo, trademark, and software design are the
property of Polen's BuyBid Auto Exchange and licensed to EzLane Auto Auctions Inc. and are
protected by U.S. copyright laws.
By the act of logging in, bidding on, consigning, buying, or selling any vehicle through EzLane
Auto Auctions, you are entering into a legal contract and agreeing to abide by and be bound by
the purchase/sales agreement and auction rules set forth herein.
Governing law. The purchase/sales agreement and auction rules set forth herein shall be
construed and governed by the laws of the state of Illinois, which laws shall prevail in the event
of any conflict of laws. Unless otherwise required by law, the parties shall submit to the
jurisdiction of the courts of DeWitt County, Illinois.
1. Sales through the Auction are intended to promote fair and ethical treatment of both the auction and the buyer. The auction may void any sale at its sole discretion and rerun the unit or repair the unit to keep the deal together. Both seller and buyer further agree that the auction reserves the right to deny use of their website / services to any dealership or dealership representatives for any reason.
2. The Auction: shall always have the option to repair or pay to repair any rejectable item within 45 days from the reported arbitration date to the satisfaction of the buyer or back-up the deal entirely. The buyer herein agrees to accept the decision of the auction.
3. Announcements: mean the auction has made statements that qualify a condition and limit arbitration of that vehicle pertaining to the announced condition. Any announced engine problem may need transport/towing to the buyer's location. The buyer is responsible for this decision and bears the responsibility if not towed.
- Ride and Drive indicate that the auction guarantees the vehicle to be free from major defects, encompassing the engine, transmission, drivetrain, and other essential components other than prior announced issues. Sellers have a responsibility to report to the auction any known defects or issues that require disclosure at the time of inspection. If such defects exist, they should be communicated to clarify the vehicle's condition.
- Arbitration Eligibility Buyers have the right to arbitrate vehicles sold, ride and drive if undisclosed defects are discovered. Specifically, any single mechanical defect with a repair cost of $850 or more is eligible for arbitration.
- The Hoist Rule We cannot guarantee any items that can only be found with use of an auto hoist. This is no difference than a buyer inspecting a unit at a brick-and-mortar auction. Examples: non-dripping leaks that do not puddle (seepage), damaged driveline boots, Frame or unibody damage to include rust holes. Please review all frame photos for excessive rust and bid accordingly. We will cover any leaks that leave a puddle.
- Engine miss Issues may be a simple fix or serious engine problem. You must listen to engine recordings and read the OBD report and make your own decision as to what the root problem is. If you buy a unit with a miss, you are gambling the problem is a simple fix and it may be a serious problem.
- Minor Problems Failing spark plugs or ignition coils, Faulty plug wires, Problems with distributor or crankshaft position sensor (in older models), Dirty or clogged fuel injectors, Failing fuel pump or fuel pressure regulator, Bad fuel or clogged fuel filter.
- Serious Problems Low or uneven compression, Burned or bent valves, worn piston rings, Blown head gasket, Dead cylinder. These indicate repair could involve a top-end rebuild or engine replacement. Our inspectors have no way to test components any of the above problems, we can only announce there is an engine miss.

Additionally, the NAAA policy specifies that Vehicle Accessories on vehicles over five years old are not subject to arbitration.

- The Timeframe: specific procedures for initiating an arbitration with a post-sale inspection fee paid. The buyer has ten (10) days to pick up the unit after this time the unit is considered sold as-is. If the unit is transported by Super Dispatch or R.C. Logistics you have (7) days to Arbitrate from your delivery date Vehicles not arbitrated within this timeframe or without a post-sale fee paid will be considered sold AS-IS.

- 4x4 System: Malfunctions within the four-wheel-drive system.
- Major drive line: Rear end to include axle problems
4. As-is: means there can be no arbitration NO EXCEPTIONS...
5. Both seller and buyer agree that the arbitration decision of the auction is final and binding on both parties. The auction may charge an arbitration fee plus any charges associated with the arbitration process to either party if there has been misrepresentation.
6. The buyer is responsible for reading announcements, comments, viewing photos, and other information before placing bids. If a bid is countered by the seller, the bidder has until 12:00 Noon the following day to accept or counter the seller's offer. If there is no acceptance or counteroffer made by the bidder, the unit may be sold to another dealer.
7. The auction makes no guarantees as to the description, equipment, history, warranties, service policy, title status, or odometer reading on any vehicle sold. The auction does guarantee it will void any sale where a misrepresentation has taken place if the buyer elects to keep the unit with a price adjustment.
8. EzLane Auctions' representative shall consign units. An area representative shall be given no less than seven days prior notice of consignment by the selling dealer. Our intention is to serve all dealers and will be done on a first-come, first-served basis.
9. The auction is not a party to the contract of the sale. The sales contract is between the seller and buyer only. The seller is required to give the federal odometer statement.
10. Any vehicle bought or sold through the efforts of EzLane Auto Auctions Inc. or because of the use of its website must be processed through the auction office and all fees paid to the auction. Dealers found to be violating this rule will be denied access to the auction website.
11. Vehicles having a reassigned VIN plate by the state in place of the original VIN plate must be announced, and any VIN plate that appears to or has been altered will be cause to void the sale.
12. Any unit that has had the suspension altered in any way or has had over size wheels / tires or has had wheel spacer installed will have NO DRIVE TRAIN GUARANTEE whatsoever. All kit vehicles, trailers, motorcycles, watercraft, recreational, antique, homemade, or modified vehicles are sold 100% "as-is" without guarantees.
13. The auction reserves the right to reject any vehicle it deems unsafe.
14. Motor and drive line noises that are inherent or typical to a particular model or due to high mileage, unless deemed excessive by the arbitrator, may not be subject to rejection.
15. Buyers must test drive each vehicle purchased with a ride and drive guarantee. Any arbitrable problems must be reported within five (5) calendar days of the unit's departure from the selling dealership. To report an arbitrable issue, go to the home page, click on the arbitration issues tab, and report the problem. If the auction is not notified of any problems within the five (5) day time frame, the transaction will be deemed completed. There will be no transportation cost refunded to the buyer on rejected units unless the auction performed a post-sale inspection.
16. Manufacturer's warranty shall not affect a buyer's right to arbitrate a vehicle.
17. All commercial vehicles must be announced.
18. The seller is responsible for reasonable transportation reimbursement to the buyer on vehicles returned for "no title" within the 45-day limit.
19. Any title discrepancies current or prior, "branded or foreign," must be announced.
20. All titles must be in the seller's name or reassigned to the seller, clear of all liens and encumbrances, and negotiable in the state where the vehicle is sold.
21. All vehicles consigned with the auction are subject to inspection by the FBI, state, and local police authorities.
22. The seller is responsible for repurchase of any vehicle found to be stolen prior to the auction date of sale.
23. Sellers selling a title-attached vehicle have the responsibility to produce a negotiable title to the auction within 45 days of the date of sale, or the buyer may return the vehicle at the cost of the seller.
24. There are no buyer transportation costs covered by regularly arbitrated/rejected units. Buyers are required to return any rejected unit to the seller's location or the office of EzLane Auctions. If a post-sale fee is paid, the auction is responsible for the transportation of any rejected units. The auction is not responsible for the delivery of non-drivable or wrecked units.
25. Post-sale inspection guarantee: standard seven-day post-sale inspection. Most new car stores have a mandatory post-sale inspection fee, which will be indicated with an asterisk next to the name on the auction consignment page.

27. Final sale price greater than $1000 are eligible for a Post Sale Inspection.

29. Post Sale Inspections applies to unannounced defects that are singularly $800 or more to repair or replace visible damage on the following.

42. If an item or part that was inspected fails during the guarantee period, the item will be replaced or repaired or bought back at our option.
43. Vehicles challenged for issues must have 100 miles or less accumulated on the odometer between the time of inspection and the challenge date.
44. The Post Sale Inspection guarantee is not a buy-back policy but a guarantee of the operation and function of the unit and items inspected.
45. The guarantees and provisions apply only to the original buyer.
46. Post Sale Inspections problems found after purchase to have arbitral items processed in the same manner as the normal arbitration process and enter into discussions with the seller.
47. Units failing a Post-Sale Inspection may be voided or repaired and sold at the Sellers discretion.
48. Unit condition at the time of return must be the same as when purchased EzLane Auctions will not reimburse a dealer for transportation, reconditioning or other work or expenses performed on units that are returned.
49. We reserve the right to limit the number of times a Purchasing Dealer may participate in this policy.
50. EzLane Auctions current Arbitration Policy will apply to all disputes.
51. Transmissions: (no arbitration on CVT transmissions over 75,000 miles).
52. Upper or lower: engine noise (no arbitration on cold start units over 150,000 miles lasting less than 10 seconds).
53. Drive-train: problems, electrical problems, 4x4 malfunctioning, check engine, ABS, SRS, etc. lights or emission control problems.
54. Paint work: three panels or more on current-year model and four years older with under 100,000 miles, glass or hail damage, upholstery, or visible body damage.
55. Flood, frame, uni-body: damage including excessive frame rust is subject to return within seven days. It is the responsibility of the seller to disclose these issues.
56. Engine miss: announcement covers coil, plugs, wiring, injector, dead cylinder.
57. We inspect every unit, and sometimes things are missed; you must review the condition report and all photos closely. Pay attention to the instrument cluster to confirm the mileage reading.
58. Electric or hybrid batteries: policy applies to vehicles up to five model years old. For vehicles over five model years old or over 100,000 miles, electric and hybrid vehicle batteries are not arbitrable.
59. The buyer agrees to a legally binding contract to buy the vehicle and pay the bid price plus all related fees. The buyer will be notified by email of the purchase, and the auction will email or fax the bill of sale(s) to both buyer and seller. The buyer must pay the auction via ACH, floorplan, or check. Checks must be payable to EzLane Auto Auctions and held until the title is mailed to the buyer.
60. The seller agrees to a legally binding contract to sell the vehicle when accepting the buyer's bid price minus the seller's fee. EzLane Auto Auctions will email the bill of sale to both the buyer and seller. When the auction receives the title from the seller, EzLane Auto Auctions will pay the seller.
61. The buyer agrees to pay for all unauthorized work done to an arbitrated or title-attached vehicle before returning it to the auction. The auction will reimburse the buyer only for authorized work performed on an arbitrated or title-attached vehicle.
62. The seller guarantees the title of vehicles sold through the auction. This guarantee of title warrants that the title shall be marketable and free and clear of all liens and encumbrances, including any brand noted upon the current or any prior certificate of title unless such encumbrances were announced at the time the vehicle was sold through the auction. The auction's liability under this title guarantee shall never exceed the auction sale price of the vehicle, and this maximum amount shall be reduced by two percent per month following the auction sale date. The auction will not be responsible for any expenses incurred on vehicles returned for late titles.
63. In the case of a title with a clerical or coding error or incomplete documentation problem, the selling dealership shall be given reasonable time after receiving notice to have the error corrected.
64. Whenever any claim is made by any person against the title of a vehicle, the buyer shall immediately notify the auction and cooperate fully in defending any legal action. The buyer shall not surrender possession of the vehicle, except as required by legal process, and shall notify the auction of any claim in a timely manner. Failure to cooperate in defending any such claim shall relieve the auction of any liability.
65. Seller and buyer agree that the auction is not responsible for odometer readings on consigned vehicles, nor the information contained in the odometer statement. However, if an error is made by the auction, it will be the auction's responsibility to correct the error in a reasonable time frame.
66. Seller and buyer agree to indemnify and hold harmless the auction from any liability arising from a defective title and any matter relating to the odometer statement.
67. The auction will reassign the title directly to the buyer. Any title assigned directly to the auction will not be accepted.
68. All non-titled vehicles and equipment must be announced and will be sold "as-is," and the auction accepts no responsibility whatsoever for this transaction.
69. Gray market vehicles must be announced and are sold as-is.
70. The term "drives good" means the unit handles well and has nothing to do with any mechanical or other announced condition.
71. Anyone not having a properly assigned title or reassignment to transfer a title or lacking a lien release at the time of sale must sell "title attached" and must be announced.
72. The buyer is cautioned not to sell or make repairs on title-attached vehicles until the title is received. Any vehicle returned for late title or other errors must be in no worse condition than when sold.
73. All units sold with an "if" will be answered as soon as possible by the selling dealership after the auction ends. If the selling dealer does not reply, a zone representative will contact the selling dealer by phone. "Ifs" work both ways-the seller may reject the buyer's offer and make a counteroffer, or the buyer may withdraw the offer at any time at their discretion.
74. All purchased units must be paid for within five (5) business days and picked up within ten (10) business days of the sale date, or the unit will be sold as-is.
75. If a dealer or agent of the dealer is found to be going around the auction or attempting to do so, that dealership's right to participate in EzLane Auto Auctions shall be terminated. Said dealership understands and accepts the auction's decision.
